OBJECTIVE

The Government of India has brought out a new legislation called “CODE ON WAGES 2019” (hereinafter referred to as The Code) by merging the Payment of Wages Act 1936, Minimum wages Act 1948, Payment of Bonus Act 1965 and the Equal Remuneration 1976.  The Code has come into force with effect from 8 August 2019. 

The Code universalizes the provisions of minimum wages irrespective of the sector and wage ceiling. There are twelve definitions of wages defined under various Labour Laws leading to litigation apart from difficulty with implementation. The definition has been simplified and is expected to reduce litigation and will entail lower cost of compliance for an employer.

Establishments will benefit as the number of registers, returns, forms etc., not only can be electronically filed and maintained, but it is envisaged that through rules, not more than one template will be prescribed. 

At present, many of the States have multiple minimum wages. The minimum wage fixation would primarily be based on geography and skills. Currently, there are more than 2000 minimum wages in the country. The Code will bring uniformity throughout the country helping more than 50 crore workers. 

Many changes have been introduced in the inspection regimes including web based randomized computerized inspection scheme, jurisdiction-free inspections, calling of information electronically for inspection, composition of fines etc. The present Inspectors will be re-designated as Inspectors cum Facilitator. All these changes will be conducive for enforcement of labour laws with transparency and accountability. To protect the interest of the workers, the limitation period has been raised to 3 years and made uniform for filing claims for minimum wages, bonus, equal remuneration etc., as against existing varying periods between 6 months to 2 years. 

 

This one-day brain storm workshop intends to study and discuss The Code in its entirety which includes Sections 1 to 69. The Code and its implications are significant in the history of Labour Laws and therefore will be very crucial for participants to understand what lies at the heart of The Code.

The workshop will be conducted by Dr. N. R. KUMARA SWAMY, who has a Ph. D in HRD from Washington International University, New Jersey, USA; Ph.D. in Law from Bangalore University; Master’s Degree Holder in Labour Laws and Master’s Degree Holder in Labour Management Studies & Post Graduate Diplomas in:

Dr. N. R. KUMARA SWAMY has approximately 43 years of extensive experience as a Professor, Trainer, Course Director and held positions in HR departments in Private (Escorts/Goetze India Ltd), Public (National Textiles Corporations Ltd) and Joint Sector (Mangalore Chemicals and Fertilizers Ltd) undertakings; taught Labour Laws and HR subjects in leading institutes of Bangalore for the last 27 years. He has further authored five books (please see next page for details). He has been faculty at Bharatiya Vidya Bhavan for the last 31 years and was the Administrative Principal of Havanur College of Law for two (2) years.

Employee’s Provident Fund (EPF) Tribunal now in Bangalore!

The Tribunal has the powers to deal only with sections 7A, 7B and 14B of the Employees Provident Funds and Miscellaneous Provisions Act 1952.
